Terms of Service

1. Acceptance of Terms

By accessing or using the Service, creating an account, or clicking “I agree”, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund & Cancellation Policy. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Definitions

• “Service” — the QUICK ZTNA Zero Trust Network Access platform, including the web dashboard, API, VPN client software, and all related services
• “User” — any individual who creates an account on the Service
• “Organisation” — a group account created by a User that may contain multiple Users and Machines
• “Machine” — a device (computer, server, container) registered with the Service
• “Data” — any information uploaded, transmitted, or generated through the Service by a User or Machine

3. Account Registration & Security

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• One natural person per account — automated account creation is prohibited unless using auth keys
• You must notify us immediately of any unauthorised access to your account
• We reserve the right to suspend accounts that violate these Terms

4. Service Description

QUICK ZTNA provides a Zero Trust Network Access platform featuring:

• WireGuard-based mesh VPN with post-quantum cryptographic key exchange (X25519 + ML-KEM-768)
• Identity-based access control with ABAC policies, SSO (OIDC/SAML), and device posture verification
• Remote workforce management including workforce analytics, session recording, and remote desktop
• Security features including threat intelligence, DLP, DNS filtering, and AI-assisted operations
• Compliance tools including immutable audit trail and report generation

5. Employee Monitoring

By using the Service within an Organisation, you acknowledge that the Organisation administrator may enable workforce monitoring features. When enabled, the following capabilities may be active:

• Activity level tracking — active/idle status, estimated keyboard and mouse activity (not raw keystrokes)
• DNS query analytics — domain access patterns and productivity categorisation
• Session recording — terminal output capture for SSH and RDP sessions
• Remote desktop access — screen viewing (peer sessions require consent dialog on your machine)
• Software inventory scanning — installed application names, versions, and publishers
• Productivity scoring — aggregated active vs. idle time ratios
• User risk scoring — behavioural risk assessment based on login patterns, device posture, and access behaviour
• Schedule compliance — machine online times compared to configured work hours
• DLP monitoring — file access events flagged by data loss prevention rules

When monitoring features are active:

• The VPN client will display a visible monitoring indicator
• The dashboard will show a monitoring notice identifying which features are enabled
• You may view your own monitoring data (activity summary, risk score) via the dashboard
• You may raise concerns with your Organisation administrator or our Grievance Officer at grievance@quickztna.com

6. Plans & Pricing

• Prices are in US Dollars (USD) unless otherwise stated
• All paid plans are billed monthly via Razorpay
• Applicable taxes (including GST where required) will be added at checkout
• We reserve the right to change pricing with 30 days’ advance notice via email

7. Free Trial

New organisations may receive a 60-day free trial of paid features. During the trial, all Business-tier features are available. At the end of the trial period:

• If you subscribe to a paid plan, your service continues uninterrupted
• If you do not subscribe, your organisation automatically downgrades to the Free plan
• No payment information is required to start the trial
• Data created during the trial is retained subject to Free plan limits

8. Acceptable Use Policy

You agree NOT to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Transmit malware, viruses, or any malicious code through the VPN tunnels
• Attempt to circumvent security controls, access controls, or rate limits
• Reverse-engineer, decompile, or disassemble any proprietary component of the Service
• Resell, sublicense, or commercially redistribute the Service without written permission
• Abuse API rate limits or conduct denial-of-service attacks
• Use the Service for mass surveillance, unauthorised interception, or data exfiltration
• Impersonate another person or entity

Violation of this policy may result in immediate suspension or termination of your account.

9. Intellectual Property

• The Service, its design, logos, and proprietary code are owned by QUICK ZTNA and protected by applicable intellectual property laws
• The VPN client includes open-source components (WireGuard, Go standard library) licensed under their respective licences
• You retain all rights to your data — see Section 10
• You grant us a limited licence to process your data solely to provide the Service

10. Data Ownership

You retain full ownership of all data you upload, transmit, or generate through the Service. We process your data only as described in our Privacy Policy. Upon termination, you may export your data for 30 days before it is permanently deleted.

11. Service Availability

• We aim for high availability but do not guarantee uninterrupted service for Free and Business plans
• Workforce plans include a custom Service Level Agreement (SLA) with defined uptime guarantees
• Scheduled maintenance will be notified at least 24 hours in advance via email and dashboard
• We are not liable for downtime caused by factors outside our reasonable control (force majeure)

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW:

• The Service is provided “as is” and “as available” without warranties of any kind
• We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement
• Our total liability for any claim arising from or related to the Service shall not exceed the fees you paid in the 12 months preceding the claim
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• For Free plan users, our maximum liability is limited to INR 1,000 (one thousand rupees)

13. Indemnification

You agree to indemnify and hold harmless QUICK ZTNA, its officers, employees, and agents from any claims, losses, or damages (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Termination

• By you: You may cancel your account at any time from Admin Settings. See our Refund & Cancellation Policy for details
• By us (with notice): We may terminate your account with 30 days’ notice for any reason
• By us (immediate): We may terminate immediately for violation of the Acceptable Use Policy or these Terms
• Data export: Upon termination, you have 30 days to export your data. After 30 days, data is permanently deleted (except where retention is legally required)
• Survival: Sections on Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution survive termination

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. The courts of Bengaluru, Karnataka shall have exclusive jurisdiction over any disputes arising from or related to these Terms or the Service.

16. Dispute Resolution

In the event of a dispute, the following process applies:

1. Grievance Officer: First, submit your complaint to our Grievance Officer at grievance@quickztna.com. We will respond within 30 days.
2. Mediation: If not resolved, both parties agree to attempt mediation in Bengaluru before initiating litigation.
3. Litigation: If mediation fails, the dispute shall be resolved by the courts of Bengaluru, Karnataka, India.

17. General Provisions

• Severability: If any provision is held invalid, the remaining provisions continue in full force
• Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and QUICK ZTNA
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger or acquisition
• Amendments: We may update these Terms with 30 days’ notice via email. Continued use constitutes acceptance
